These Terms of Service ("Terms") govern your use of the menu.band website and services. By using our website or services, you agree to be bound by these Terms. Please read them carefully.

1. Service Description

menu.band provides digital menu creation services for restaurants and food service establishments. Our services include:

  • Custom digital menu design and development
  • AI-generated food photography
  • Multilingual menu descriptions
  • QR code generation for menu access
  • Hosting and maintenance of digital menus

3. Free Demo

We offer a free demo that includes a sample of your actual menu items. The demo is provided without obligation and does not constitute a binding contract for ongoing services. The demo remains our intellectual property until a paid service agreement is established.

4. Paid Services

4.1 Subscription Plans

Our paid services are offered on a flat annual basis. Current plans and pricing are displayed on our website. Additional credits for menu updates can be purchased separately and never expire. We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

4.2 Payment Terms

Payments are due at the beginning of each billing period. We accept payment methods as displayed at checkout. All prices are in Euros (€) and include applicable VAT (IVA) where required by Italian tax law.

4.3 Right of Withdrawal

In accordance with Articles 52-59 of the Italian Consumer Code (D.Lgs. 206/2005), consumers have the right to withdraw from the contract within 14 days from the conclusion of the service agreement, without providing any reason. To exercise this right, please contact us at hello@menu.band with a clear statement of your decision to withdraw.

If you have requested that the service begin during the withdrawal period, you shall pay us an amount proportional to what has been provided until you communicated your withdrawal.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • Your service will continue until the end of the current billing period
  • No refunds are provided for partial billing periods
  • Your digital menu will be deactivated at the end of the billing period
  • You may request export of your menu data before deactivation

5. Intellectual Property

5.1 Our Content

The menu.band website design, code, visual elements, and branding are the intellectual property of menu.band and are protected under Italian copyright law (L. 633/1941) and applicable EU directives.

5.2 Your Content

You retain ownership of all content you provide to us (menu items, restaurant information, photos). By submitting content, you grant us a non-exclusive license to use it for the purpose of creating and hosting your digital menu.

5.3 AI-Generated Content

AI-generated images and descriptions created for your menu are licensed to you for use in connection with your digital menu for the duration of your subscription. The underlying AI models and generation techniques remain our intellectual property.

6. User Obligations

By using our services, you agree to:

  • Provide accurate and truthful information about your restaurant and menu
  • Not use our services for any illegal or unauthorized purpose
  • Not attempt to reverse-engineer or copy our technology or designs
  • Ensure that all content you provide does not infringe third-party rights
  • Comply with applicable food labeling and allergen information regulations

7. Limitation of Liability

To the maximum extent permitted by Italian law (including Articles 1218-1229 of the Italian Civil Code):

  • Our liability for damages arising from or related to the use of our services shall not exceed the total amount paid by you in the 12 months preceding the event giving rise to the claim.
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
  • We are not responsible for the accuracy of menu information provided by you or for compliance with local food safety regulations, which remain your responsibility.

Nothing in these Terms shall limit or exclude our liability for willful misconduct (dolo) or gross negligence (colpa grave) as provided by Italian law.

8. Warranty Disclaimer

Our services are provided "as is" and "as available." While we strive to deliver high-quality services, we do not guarantee:

  • Uninterrupted or error-free service availability
  • That AI-generated images will perfectly represent your actual dishes
  • Specific business results from using our digital menus

9. Data Protection

Our handling of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. We process personal data in compliance with the GDPR and Italian data protection legislation.

10. Alternative Dispute Resolution

In accordance with EU Regulation 524/2013, we inform consumers that the European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

Before initiating formal proceedings, we encourage you to contact us directly to resolve any disputes amicably.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent court in Italy.

For consumers residing in Italy, the mandatory provisions of the Italian Consumer Code (D.Lgs. 206/2005) shall apply, including the mandatory jurisdiction of the consumer's place of residence.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated to subscribers at least 30 days in advance. Continued use of our services after such changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
