Terms of Service

These Terms of Service ("Terms") govern your use of the menu.band website and digital menu creation service ("Service") operated by menu.band ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Service Description

menu.band provides a custom digital menu creation service for restaurants and food establishments. We study your restaurant, create AI-generated food photography, write multilingual dish descriptions, and deliver a custom-designed responsive digital menu.

2. Demo and Free Trial

We offer a free demo that includes a sample of your actual menu items presented in our digital format. The demo is provided without obligation and does not constitute a binding contract for paid services.

3. User Obligations

When using our Service, you agree to:

  • Provide accurate and complete information about your restaurant and menu
  • Ensure you have the right to share any materials (photos, menus, etc.) you provide to us
  • Not use the Service for any unlawful purpose
  • Not attempt to access or use the Service in a manner that violates these Terms

4. Paid Services

4.1 Subscription Plans

Our paid services are offered on a flat annual basis. Current plans and pricing are displayed on our website. Additional credits for menu updates can be purchased separately and never expire. We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

4.2 Payment Terms

Payments are due at the beginning of each billing period. We accept payment methods as displayed at checkout. All prices are in Euros (€) and include applicable VAT (IVA) where required by Italian tax law.

4.3 Right of Withdrawal

In accordance with Articles 52-59 of the Italian Consumer Code (D.Lgs. 206/2005), consumers have the right to withdraw from the contract within 14 days from the conclusion of the service agreement, without providing any reason. To exercise this right, please contact us at hello@menu.band.

5. Intellectual Property

5.1 Our Content

The menu.band website, design system, and platform are owned by menu.band. Our brand, logo, and proprietary technology remain our intellectual property.

5.2 Your Content

You retain ownership of the content you provide to us (menu items, descriptions, original photos). The custom menu designs we create are licensed to you for use during your active subscription.

5.3 AI-Generated Content

AI-generated food photography and descriptions created for your menu are licensed to you for use within the menu.band platform and any printed QR code materials during your active subscription.

6. Limitation of Liability

To the maximum extent permitted by Italian and EU law, our liability is limited to the amount paid by you for the Service in the 12 months preceding the claim.

7. Termination

Either party may terminate the service agreement with 30 days' written notice. Upon termination, your digital menu will be deactivated and your data will be handled in accordance with our Privacy Policy.

8. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes will be subject to the exclusive jurisdiction of the courts of [City, Italy], without prejudice to the consumer's right to bring proceedings in the courts of their place of residence.
